Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Smile On! AI Smile Makeover web application (the "Service"), operated by RAJAN Dental ("RAJAN Dental", "we", "us", "our"). By using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Smile On! lets you upload a photo and receive AI-generated illustrative previews of how your smile might look in different cosmetic styles. Previews are for visualisation and inspiration only. They are not a diagnosis, treatment plan, clinical recommendation, or promise of any outcome. Any dental treatment decisions must be made with a qualified clinician after an in-person consultation.

2. Eligibility

You must be at least 13 years old to use the Service. If you are under the age of majority in your jurisdiction, you must have a parent or guardian's consent before using the Service or uploading any photo.

3. Accounts and verification

We use Google Sign-In to verify accounts and protect uploaded photos from misuse. You are responsible for keeping your Google account credentials secure and for all activity on your account. Notify us promptly of any unauthorised use.

4. Your content and licence to us

You retain ownership of the photos you upload ("Your Content"). You represent and warrant that:

• You own or have the necessary rights to Your Content.
• You have permission from any individual depicted in Your Content to upload it and have it processed by the Service.
• Your Content does not infringe any third-party rights or violate any applicable law.

You grant RAJAN Dental a worldwide, royalty-free, non-exclusive licence to host, store, process, reproduce, and create derivative works from Your Content solely to operate, provide, and improve the Service and to generate the previews you request. This licence ends when you (or we) delete Your Content, except as needed to comply with law or enforce these Terms.

5. Acceptable use

When you use the Service, you agree not to:

• Upload photos of other people without their informed consent, or photos of minors without parental consent.
• Upload content that is unlawful, harmful, harassing, defamatory, obscene, or infringes intellectual property or privacy rights.
• Attempt to probe, scan, reverse-engineer, or disrupt the Service or its underlying systems.
• Use the Service to build a competing product, train third-party AI models, or scrape data.
• Use generated images in a way that misrepresents a real person's dental condition or a clinical outcome.
• Use the Service to create deceptive, defamatory, or deepfake media.

6. AI-generated content

AI-generated previews are illustrative and may contain inaccuracies, artefacts, or unrealistic features. Results vary and may not reflect any actual treatment outcome. Do not rely on generated images for medical, dental, or cosmetic decisions.

7. Bookings and consultations

The Service may offer you the option to book a consultation at RAJAN Dental. Bookings and any resulting dental services are governed by RAJAN Dental's clinical policies and any separate agreements you enter into for those services. The availability of a preview does not create an obligation to provide any particular treatment.

8. Privacy and tracking

Your use of the Service is also governed by our Privacy Policy. The Service uses Google Analytics, Microsoft Clarity, and the Meta Pixel to understand usage and measure advertising; see the Privacy Policy for details and opt-out options.

9. Intellectual property

The Service, including its software, design, branding, and content (excluding Your Content), is owned by RAJAN Dental or its licensors and is protected by applicable intellectual-property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the Service for its intended purpose.

10. Termination

You may stop using the Service and request account deletion at any time. We may suspend or terminate your access if you breach these Terms, misuse the Service, or if required by law. Provisions that by their nature should survive termination will survive, including sections on content licence, disclaimers, limitation of liability, and governing law.

11. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including fitness for a particular purpose, merchantability, accuracy, and non-infringement. RAJAN Dental does not warrant that the Service will be uninterrupted, error-free, secure, or that AI-generated results will be accurate or suitable for any purpose. The Service does not provide medical or dental advice.

12. Limitation of liability

To the maximum extent permitted by law, RAJAN Dental and its affiliates, officers, employees, and service providers will not be liable for any indirect, incidental, consequential, special, or punitive damages, or loss of profits, data, goodwill, or business, arising out of or relating to your use of the Service. Our aggregate liability for any claim relating to the Service is limited to the amount you paid us to use the Service in the twelve months preceding the claim, or, if you paid nothing, INR 1,000.

13. Indemnification

You agree to indemnify and hold harmless RAJAN Dental from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service, Your Content, or your breach of these Terms.

14. Governing law and jurisdiction

These Terms are governed by the laws of India. Subject to applicable law, you agree to submit to the exclusive jurisdiction of the courts located in Chennai, Tamil Nadu, India for any dispute arising out of or relating to these Terms or the Service.

15. Changes to these Terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. Continued use of the Service after changes take effect means you accept the updated Terms.
